Terms and Conditions
This warranty applies only to Dura Deck, Dura Tiles, Dura Cladding, Dura Louvre, Dura Balustrading and Dura PVC Park Deck from Dura Composites. Products must be installed in strict accordance with the manufacturer’s instructions and the guidance in our free downloadable Technical Installation Manuals.

This warranty is given to the purchaser of Dura Deck composite timber decking materials, fixings and fasteners, Dura Park Deck PVC decking, Dura Tile composite timber floor tiles, Dura Cladding composite timber cladding, fixings and fasteners, Dura Louvre composite timber solar shading cladding, fixings and fasteners, Dura Pergola composite timber pergolas and Dura Balustrading composite timber handrailing, fixings and fasteners. For purposes of this warranty, “purchaser” shall refer to the named person who completes the online warranty activation form.
Dura Composites Limited (Dura Composites) warrants to Purchaser that, for a period of 10 (10) years from the date of the original purchase (the term), under normal use and service conditions, that: (1) the materials will be free from material defects in workmanship, and will not split, splinter, rot or suffer structural damage from termites or fungal decay; (2) the materials will not peel, crack or corrode as a result of manufacturing defects, or as a result of exposure to ocean air (salt spray). (3) the materials will not warp so long as Dura Composites design and installation guidelines and techniques are strictly adhered to; This warranty does not extend to fasteners or fixings not supplied by Dura Composites.
All warranties are subject to exclusions, limitations and restrictions set forth below:
- Obtaining Warranty Performance: If Purchaser discovers a defect in a Dura Composites Architectural or Landscaping product listed above during the term, Purchaser must, within thirty (30) days from the discovery of the alleged defect but no later than the end of the term, notify Dura Composites in writing, at the address above.
- Purchaser must include in this notification proof of purchase and a statement explaining the defect. Dura Composites may request additional information and/or detailed photographs. After reviewing the information, Dura Composites will make a determination regarding the validity of the claim. If Dura Composites determines that the Purchaser’s claim is valid, Dura Composites will, at its option, either replace the defective product(s) or refund the portion of the purchase price paid by Purchaser relating to the defective Dura product(s) (not including any initial installation costs if applicable).
This warranty shall not cover, and Dura Composites shall not be responsible for, costs and expenses incurred with respect to the removal of the defective Dura product(s) or the installation of replacement materials, including but not limited to, labour. The foregoing remedies are the sole and exclusive remedy for breach of any warranty.
Exclusions from Warranty Coverage: Dura Composites does not warranty against and is not responsible for, and no implied warranty shall be deemed to cover product failure, product malfunction, or damages attributable to: (1) improper installation of the Dura products and/or failure to abide by Dura Composites installation techniques, including but not limited to improper gapping; (2) use of the Dura Composite products beyond specified load values or in an application not recommended by Dura Composites; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the products are installed; (4) any natural disaster (flooding, hurricane, earthquake, lightning etc) environmental condition (such as air pollution, mould, mildew etc.) or staining from foreign substances (such as dirt, grease, oil etc); (5) normal weathering due to exposure to sunlight, weather and atmosphere which can cause coloured surfaces to, amongst other things, accumulate dirt or stains and/or change colour; or (6) improper handling, storage, abuse or neglect of the Dura Deck products by Purchaser, the transferee or third parties.
Limitations: DISCLAIMER OF WARRANTIES: Except for the express warranty contained herein, Dura Composites makes no other warranties, guarantees or indemnities, whether express or implied, arising by law, course of dealing, usage of trade, custom or otherwise, including but not limited to the implied warranty of saleability and implied warranty of fitness for a particular purpose, and all such other warranties, guarantees and indemnities are hereby disclaimed, overridden and excluded from this transaction.
Limitation of remedies and exclusion of consequential and incidental damages: Dura Composites liabilities are limited solely and exclusively to the obligations specifically undertaken herein, and under no circumstances will Dura Composites be liable or obligated for any incidental, consequential, indirect, special, punitive or any other damages of any kind whatsoever (including, but not limited to, lost profits, lost sales, loss of goodwill, use of money, use of goods, stoppage of work, or impairment of assets), whether foreseeable or unforeseeable, arising out of breach or failure of express or implied warranty, breach of contract, fraud, misrepresentation, law of mandatory application. Dura Composites liability with respect to defective products shall in no event exceed the replacement of such products or refund of the purchase price, as described above.
With respect to a residential application, this warranty may be transferred during the 10 year period beginning from the date of original purchase by the Purchaser, to a subsequent buyer of the property upon which the Dura Composites products were originally installed provided install and maintenance conditions have been strictly adhered to. With respect to a commercial application, this warranty is freely transferable to subsequent buyers of the property upon which the Dura Composites products were originally installed – again provided the install and maintenance conditions have been strictly adhered to.
This writing is understood and intended to be the final expression of the parties’ agreement and is a complete and exclusive statement of the terms and conditions with respect thereto, superseding all prior agreements or representations, oral or written, and all other communication between parties relating to the subject matter of this agreement. The warranty may not be altered or amended except in a written instrument signed by Dura Composites and Purchaser or permitted transferee. No agent, employee or any other party is authorised to make any warranty in addition to that made in this agreement and Dura Composites shall not be bound by any such statements other than those contained in this warranty.
